Terms of Use (EULA)

These Terms of Use and End User License Agreement ("Terms") govern your access to and use of BuddySay: No More Heartbreak ("BuddySay," "we," "us," or "our"). By downloading BuddySay from the Apple App Store, accessing, subscribing to, or using BuddySay, you agree to these Terms.

These Terms are between you and BuddySay only, not Apple. BuddySay, not Apple, is solely responsible for the app, its content, maintenance, support, warranties, and claims related to BuddySay, except where Apple is responsible under applicable law.

License to Use the App

BuddySay grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial use on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions, including applicable Family Sharing, volume purchasing, or similar Apple usage rules.

Use of BuddySay

BuddySay is an AI-powered emotional recovery companion for private voice journaling, guided reflection, emotional clarity, and daily coping support. You agree to use BuddySay only for lawful, personal purposes and in accordance with these Terms.

Not Medical, Therapy, or Crisis Care

BuddySay is not therapy, medical advice, mental health treatment, diagnosis, or a crisis response service. AI-generated reflections may be supportive, but they are not a substitute for a licensed professional. If you are in immediate danger, may harm yourself or others, or need urgent help, contact emergency services or a qualified crisis hotline immediately.

AI-Generated Content

BuddySay may generate reflections, emotional insights, patterns, coping prompts, and supportive perspective based on your voice journals or other inputs. AI output may be incomplete, inaccurate, or not appropriate for every situation. You are responsible for deciding how to use any output.

Your Content

You may provide voice recordings, transcripts, written notes, mood entries, companion messages, mood selections, prompts, and other content ("User Content"). You retain ownership of your User Content. You grant us the rights needed to operate, provide, secure, and improve BuddySay, including processing User Content to generate app responses and features.

Acceptable Use

You agree not to misuse BuddySay, attempt to reverse engineer or disrupt the app, upload unlawful or harmful content, violate another person's rights, use the app to harass or harm others, or use generated output for illegal, abusive, medical, legal, financial, or other high-risk decisions.

Subscriptions and Purchases

BuddySay may offer auto-renewable subscriptions through Apple In-App Purchase. The subscription title, subscription length, price, and any price per unit are shown in the app's purchase flow before purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your Apple Account will be charged for renewal within 24 hours before the end of the current period unless you cancel. You can manage or cancel subscriptions in your Apple Account settings. Refunds and billing are handled by Apple according to Apple's policies.

Maintenance and Support

BuddySay is responsible for providing maintenance and support for the app as required by applicable law. Apple has no obligation to provide maintenance or support services for BuddySay.

Warranty

BuddySay is provided "as is" and "as available." To the extent any warranty cannot be disclaimed under applicable law, BuddySay is solely responsible for that warranty. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to Apple policy. To the maximum extent permitted by law, Apple has no other warranty obligation for BuddySay.

Product Claims

BuddySay, not Apple, is responsible for addressing claims by you or any third party relating to the app or your possession or use of the app, including product liability claims, regulatory claims, consumer protection claims, privacy claims, or claims that the app fails to conform to legal requirements.

Intellectual Property Claims

If a third party claims that BuddySay or your possession and use of BuddySay infringes that third party's intellectual property rights, BuddySay, not Apple, is responsible for investigating, defending, settling, and discharging that claim.

Legal Compliance and Export Rules

You represent and warrant that you are not located in a country subject to a United States government embargo or designated by the United States government as a terrorist-supporting country, and that you are not listed on any United States government list of prohibited or restricted parties. You agree to comply with applicable export, sanctions, and technology control laws.

Third-Party Terms

You must comply with applicable third-party terms when using BuddySay, including Apple Media Services terms, App Store terms, internet access terms, mobile carrier terms, and any terms that apply to services used by the app.

Privacy

Our Privacy Policy explains how information is collected, used, and shared, including when journal content is sent to a third-party AI service to generate responses. By using BuddySay, you also agree to the practices described in the Privacy Policy.

Intellectual Property

BuddySay, including its design, software, branding, and app content, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you ownership of BuddySay.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from your use of BuddySay.

Changes and Termination

We may modify, suspend, or discontinue BuddySay or these Terms at any time. We may suspend or terminate access if we believe you violated these Terms or if necessary to protect users, the app, or legal compliance.

Apple as Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

Governing Law

These Terms are governed by the laws applicable in the jurisdiction where BuddySay is operated, without regard to conflict of law principles, unless a different law is required by your local consumer protection rules.
